Tape Tests Kosovo's Justice System

GNJILANE, Yugoslavia (AP) - A surveillance tape that shows U.S. troops at the scene of a fatal shooting has become critical evidence in a test of whether Kosovo's justice system can give any non-Albanian a fair trial.

The case involves three Serbs on trial for murder in an ethnic Albanian court and stems from a July 10 incident in the eastern Kosovo city of Gnjilane, part of the U.S. sector of Kosovo.

``Mirko'' Momcilovic, 60, and his two sons are accused of murdering an ethnic Albanian, Afrim Gagica - a death recorded on video by a security surveillance camera.

The incident began when the elder Momcilovic answered the intercom of his motorcycle repair shop and spoke with a stranger who ultimately demanded that he come out and surrender his weapons.

Gun drawn, a man later identified as Gagica tried to kick the door down as his armed companions looked on. An exchange of gunfire followed. Minutes later, U.S. troops entered the picture.

Although the tape does not clearly show who killed Gagica, human rights observers contend it raises doubt about who did. They contend just about anyone at the scene could have fired the fatal shots.

``Everyone is aware of the signal this case will send out to the world,'' said Rolf Welberts, the director of human rights and rule of law for the Organization for Security and Cooperation in Europe in Pristina.

Without the videotape, the case boils down to whether the ethnic Albanian court will believe the Serb defendants or ethnic Albanians. U.S. soldiers have not been called to testify by the defense, who noted the Americans had rotated out of Kosovo and that it would be costly to bring them back.

Instead, he's relying on Army statements that he will submit to the court and the videotape. The Army has declined to comment on the case.

Much of the case revolves around whether Momcilovic and his sons, Jugoslav, 32, and Boban, 25, acted in self defense. A copy of the videotape obtained by The Associated Press shows Gagica and his companions wielding guns even as they step up to the intercom to demand that Momcilovic come outside.

It is not the only element that bolsters the defense. A preliminary U.S. military investigation concluded Gagica and his associates ``went to the Momcilovic residence with criminal intent. The Momcilovic family felt threatened and defended their home and lives.''

The videotape is what makes this case different from about 40 others involving inter-ethnic crimes working their way through the court system. However, Kosovo's U.N. administrators have not yet decided whether the tape is admissible as evidence. They have been reviewing it since April for authenticity. The trial has been adjourned until a decision is made.

Meanwhile, an internal OSCE document leaked to Kosovo's leading daily, Koha Ditore, said no forensic evidence exists to show that the bullet that killed Gagica was fired by the Momcilovics.

The defendants have languished at the U.S. Army's detention facility at Camp Bondsteel since the shooting. The surviving ethnic Albanians - including one accused of firing at U.S. soldiers - have all been released by an ethnic Albanian judge.

The three Serbs admit they fired the shots from the second-floor window of the motorcycle shop, but contend they were trying to warn U.S. troops. Terrified of what could happen to a Serb in postwar Kosovo, they insist they were fighting for their lives.

After the shooting, the Momcilovics' home was looted and burned, and the rest of the family fled to Serbia. The men, who were interviewed in a hot plywood shack at Bondsteel, have each other, their plastic sandals and their bright orange prison uniforms.

``They have taken everything from us,'' Boban Momcilovic said before putting his head in his hands, blurting out that he had planned to be married in August. ``It is so hard. At one moment you have everything, and at that moment, it is all taken away.''

Gagica's family feels equally cheated, certain that the 29-year-old was gunned down without cause by Serbs, the people held responsible for Yugoslav President Slobodan Milosevic's decade-long campaign of oppression.

Gagica's picture before a Kosovo Liberation Army banner is a cherished memento in their immaculate home. His brothers, Besim, 37, and Hafiz, 39, don't really care too much what the district court in Gnjilane decides.

The family has already made up its mind. Videos, they point out, can be manipulated and pictures or no pictures, they are sure the Momcilovics are guilty. They make it clear the family will never be welcome again in town.

``We'll never forgive them,'' Besim Gagica said. ``Ever.
